Court decision regarding dispute with Tivoli Arendus OÜ
Harju County Court decided on 23 April 2015 in the civil matter „Action of Nordecon AS against Tivoli Arendus OÜ regarding the establishment of termination of the agreement, claiming the debt, the late interest, the return of the guarantee and the counterclaim of Tivoli Arendus OÜ against Nordecon AS claiming for the contractual penalty and late interest.“
The court has found that the agreement was terminated lawfully by Nordecon AS by withdrawing from the agreement and Tivoli Arendus OÜ does not have the right to realise the bank guarantee in the amount of ca 1.3 million euros that was granted as a security with respect of the construction agreement. Tivoli Arendus OÜ was also ordered to pay the debt and the late interest in favor of Nordecon AS in the total approximate amount of 182 thousand euros.
The court fully rejected the claims of Tivoli Arendus OÜ submitted as the counter claim. Tivoli Arendus OÜ has the possibility to file an appeal at the latest on 23 May 2015.
